The petitioner seeks regular bail in connection with Bahadurganj P.S. Case No. 226 of 2019 for the offences punishable under Sections 379/411/34 of the Indian Penal Code. The allegation is regarding a motorcycle having been stolen by the accused persons including the petitioner herein. The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case and in fact he was caught along with two other accused persons with the stolen motorcycle by the local people when the other accused person was trying to flee away with the stolen motorcycle. It is further submitted that the petitioner is accused in 11 other cases, but the fact is that he has been remanded in all
Patna High Court CR. MISC. No.74867 of 2019(2) dt.04-12-2019 2/2 cases after being made accused in the present case and he is on bail in all the aforesaid 11 cases. It is further submitted that similarly situated other accused person has already been granted bail by a co-ordinate Bench of this Court vide order dated 24.10.2019 passed in Cr. Misc. No. 66348 of 2019. The petitioner is languishing in custody since 29.07.2019. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishangaj in connection with Bahadurganj P.S. Case No. 226 of 2019.
