2. The petitioner has preferred this application for grant of regular bail in connection with Ramgarh P.S. Case No. 257 of 2024 dated 27.07.2024 registered for the offence punishable under Sections 65(1) read with 3(5) of the Bhartiya Nyaya Sanhita and Section 4 of the POCSO Act.

3. As per the prosecution case, on 25.07.2024, the victim girl was standing near Ramgarh Police Station, in the meantime, three boys came in white coloured magic vehicle and they forcefully made her sit in the said vehicle and took her in a hotel in Station Road Mohania where Mannu Kumar @ Sonu

Patna High Court CR. MISC. No.89860 of 2024(2) dt.19-02-2025 2/2 Kumar (petitioner) committed rape on her forcibly.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 28.07.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the victim is a minor girl aged about 12 years and the petitioner committed rape on her. It is further submitted that the victim girl in her statement recorded u/s 161 and 164 of the Cr. PC has also corroborated the allegation levelled against the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the specific and heinous nature of allegation against the petitioner, this Court is not inclined to grant bail to the petitioner and the same is rejected in connection with Ramgarh P.S. Case No. 257 of 2024 pending in the court of learned A.D.J.-VI, Kaimur, Bhabhua.

7. The application stands rejected.
