Petitioner is in custody in connection with Kesaria P.S. Case No. 107 of 2018 for offence under Sections 272, 273 of the Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel submits that petitioner has no criminal antecedent, he has arrested in connection with recovery of 12.7 litre liquor. Learned counsel submits that petitioner has been made accused only on suspicion, nothing was recovered from his conscious possession. Learned counsel submits that he was neither on spot nor anything recovered from his possession. He is in custody since 16.04.2018.
Considering the totality of the fact and situation, let
Patna High Court Cr.Misc. No.33256 of 2018(2) dt.05-06-2018 2/2 the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge-cum-Special Judge Excise, Mothihari (East Champaran) in connection with Kesaria P.S. Case No. 107 of 2018 with the condition that the bailer should be the family members of the petitioner.
