2. Vide order no.5 dated 30.08.2025, this Court has demanded an explanation from the District & Additional Sessions Judge-IX, Aurangabad that under what circumstance, the contradictory paragraph has been written in his report contained in Letter No.133/2025 dated 21.07.2025. The explanation contained in Letter No. 1553/2025 dated 04.09.2025 has been received which is hereby accepted.
3. It has been intimated in the said letter of explanation that evidence of all witnesses have been completed. The name of doctor has not been inserted in the charge-sheet and it is due to this reason on the request of learned A.P.P, the Court has called for the said doctor. And only due to this reason,
Patna High Court CR. MISC. No.85646 of 2024(6) dt.26-09-2025 2/2 it is stated in the earlier report that all witnesses examined and doctor's evidence was not taken.
4. Learned counsel for the petitioner submits that the prosecution evidence is closed and the case is fixed for statement of accused persons under section 313 of the Cr.P.C. on 08.09.2025.
5. In this background, the bail application with regard to the present petitioner in connection with Sessions Trial No.216 of 2024/337 of 2024 arising out of Nabinagar P.S. Case No.420 of 2023 pending in the Court of Additional Sessions Judge-IX, Aurangabad is hereby dismissed with a direction to the trial court to conclude the trial at the earliest.
