In the instant petition, the petitioner has prayed for anticipatory bail in connection with Barahara P.S. Case No. 293 of 2019 for the offences punishable under Sections 145, 148, 31, 323, 504, 307 and 506 of the Indian Penal Code pending before the Additional Chief Judicial Magistrate, Bhojpur at Ara. It is scuffle between two parties in which petitioner and others have been arrayed as accused. One of the offences involved in the present petition is of Section 307 IPC. Perusal of injury report, it is evident that injury has been caused on the vital part of body namely head. Therefore, the petitioner has not made out a case so as to grant anticipatory bail in the light of the Apex Court decision in the case of Nathu Singh vs. State of Uttar Pradesh reported in (2021) 6 SCC 64.
