JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-02-2020 This application has been filed for cancellation of the anticipatory bail granted to the O.P.no.2 vide order dated 6.4.2019 in connection with Muzaffarpur Town P.S.Case no.922 of 2018 passed by Sessions Judge, Muzaffarpur in ABP No.617 of 2019 under Sections 420, 406, 504 and 506 of the IPC.
Grounds for cancellation of the bail is that O.Pno.2 is not ready to re-pay the remaining amount of the informant but without considering the same, anticipatory bail has been granted to him .
Heard learned APP and perused the impugned order from which it appears that the anticipatory bail has been granted
Patna High Court CR. MISC. No.80905 of 2019(2) dt.17-02-2020 2/2 to the O.P.no.2 and the O.P.no.2 is still ready to re-pay the remaining amount to the informant.
In such view of the matter this application is dispoed of with a direction to the petitioner to move before the learned session Judge, Muzaffarpur under Section 437(5) of the Cr.P.C. with regard to repayment of the amount who will consider the same and after hearing the parties, he will pass an appropriate order.
