2. The petitioner seeks bail in Halsi P.S. Case No. 27/2024 registered for the offence under Section 302, 201/34 of the Indian Penal Code.

3. As per prosecution case, sister of informant was married with this petitioner five years ago and petitioner used to assault and abuse her. On 31.01.2024, the informant received a call from her sister, who told that petitioner assaulted her badly and on next morning, petitioner informed the informant that his sister (deceased) has committed suicide by hanging and has been taken to hospital. It is further alleged that when informant rushed to hospital, he did not find dead-body of his sister and

4. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case merely because he happens to be husband of the deceased. There is no eye-witness to the occurrence. There is no allegation of demand of dowry against this petitioner. In fact, the deceased herself committed suicide by hanging. He further submits that it was this petitioner, who informed the informant regarding death of deceased and as such, he cannot be made responsible for death of deceased. Petitioner is in custody since 05.03.2024.

5. However, learned A.P.P. for the State opposed the bail petition and submitted that petitioner is husband of deceased and there is specific and direct allegation against him of committing torture. The dead-body of deceased was found from a ditch near Pandarak and there is no explanation as to how the dead-body was found in ditch. Post-mortem report shows that cause of death is head and chest injury, which clearly shows that deceased has not committed suicide. The deceased died at her matrimonial home in an unnatural circumstances.

6. Considering the nature and gravity of offence and the fact that petitioner is husband of the deceased and there is specific and direct allegation against him, the prayer for bail of
