The petitioners apprehend their arrest in connection with Uchakagaon P.S. Case No. 207 of 2019 for the offence punishable under Sections 307, 379, 506/34 and other allied sections of the Indian Penal Code.

The allegation is regarding the petitioners having assaulted the informant and her son as also having snatched Mangalsutra and some money from the informant. The learned counsel for the petitioners has submitted that the petitioners are innocent and have been falsely

No.78786 of 2019(2) dt.03-12-2019 2/3 implicated in the present case inasmuch as the present case arises out of a case and counter case, the case filed by the petitioners having been lodged first in time. It is further submitted that the injury report would show that the injuries inflicted upon the informant and her son are simple in nature. It is further submitted that the petitioners are having clean antecedent and are ready to abide by whatever conditions as may be deemed fit and proper to be imposed by this Court. The learned counsel for the informant has vehemently opposed the prayer for anticipatory bail.

Having regard to the facts and circumstances of the case, in the event of arrest or surrender in the court below within a period of four weeks from today, the petitioners above named are directed to be released on anticipatory bail on furnishing bail- bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, Gopalganj in connection with Uchakagaon P.S. Case No. 207 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.

It is further directed that the petitioners would mark their presence before the Officer Incharge of the concerned
