====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-02-2025 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 420, 406 of the Indian Penal Code.

3. As per prosecution case, petitioner No. 1 got the land of informant transferred in the name of his wife by declaring informant as a dead person.

4. Learned counsel for the petitioners submits that informant is father of petitioner No. 1, father-in-law of petitioner No. 2, maternal uncle of petitioner No. 3 and petitioner Nos. 4 & 5 are co-villagers. The land mentioned in F.I.R. is Khatiyani land of grandfather of petitioner No. 1 and he transferred his share of land to petitioner No. 2 through registered sale deed Nos. 10728 dated 1.6.23 and 10626 dated 31.5.23 and due to typographical error, his father has been shown as dead. It is further submitted that petitioner No. 1 has also filed title suit No. 9 of 24 for partition of ancestral land and this false and concocted case has been lodged against petitioners to put pressure upon them to withdraw the aforesaid title suit. Moreover, dispute is purely of civil nature. Petitioners claim clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like
