Petitioner in the present case is seeking regular bail in connection with Rajauli P.S. Case No. 333 of 2019 registered for the offences punishable under Section 395 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is not named in the FIR and nothing has been recovered from his possession. It is further submitted that the petitioner has not been identified during his custody and he is in custody since 12.09.2019.
Learned A.P.P. for the State has opposed the prayer for bail, however, learned APP for the State has accepted that similarly situated persons have been granted privilege of regular

Considering the facts and circumstances of the case, wherein the petitioner is not named in the FIR and nothing has been recovered from his possession as also he has not been identified during his custody so far and that learned APP for the State has accepted that similarly situated persons have been granted privilege of regular bail by a learned Co-ordinate Bench of this Court, let the petitioner above named be released on bail in connection with Rajauli P.S. Case No. 333 of 2019 on furnishing of bail bond of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, subject to the condition as laid down under Section 437 (3) Cr.P.C.
