The petitioner apprehends his arrest in connection with Laheri P.S. Case No.391 of 2019, registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
The informant, Sub Inspector of Police in Laheri Police Station, got secret information that petitioner Birmani Kumar and Raju Kumar were unloading country-made wine and foreign liquor from a Maruti Suzuki vehicle bearing Registration No.HR-51Z-1929. When the informant went there along with other police officials, the petitioner and his associate managed to flee away but on search, from the vehicle about 42 liters of liquor was recovered.
Learned counsel for the petitioners submits that on
Patna High Court CR. MISC. No.82837 of 2019(2) dt.13-12-2019 2/2 mere suspicion, the petitioner has been implicated in the present case. The petitioner is not owner of the said vehicle. It appears that the petitioner and Raju Kumar, who had managed to flee away leaving the said vehicle, were unloading consignment from the vehicle and when the police went there, they managed to flee away. The petitioner is also accused in six other cases of similar nature of offence and other offences. Taking into consideration the fact aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail is rejected.
