In this case, the petitioner is seeking anticipatory bail in connection with Patna Mahila P.S. Case No. 29 of 2019, registered for the offence under Sections 341, 342, 323, 498A/354/504/506/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is ready to keep his wife with proper honour and dignity and will not torture her in any manner physically or mentally.

Learned counsel for the opposite party no.2 submits that the opposite party no.2 is also already ready to live with petitioner.

No.75055 of 2019(4) dt.06-03-2020 2/2 Considering the aforesaid facts, let the petitioner, above named, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Patna, in connection with Patna Mahila P.S. Case No.29 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. Both the parties are directed to remain present before the Presiding Officer on 27.03.2020, from where the petitioner would carry his wife i.e. opposite party no.2. The Presiding Officer will monitor the behaviour of both the parties and time to time will call both the parties and enquiry in what manner they are living together.
