JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-07-2018 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Panjiwara PS case no. 71 of 2017 instituted for the offences punishable under Section 392 of Indian Penal Code. The allegation is regarding unknown miscreants having intercepted the informant and looted various articles including motorcycle from the informant.

The learned counsel for the petitioner submits that the petitioner has not been named in the FIR, his name has transpired upon confessional statement made by the accused person namely Bhushan Sah and similarly situated two accused persons' name has also transpired upon confessional statement

Patna High Court Cr.Misc. No.33810 of 2018 (3) dt.23-07-2018 2/2 made by Bhushan Sah. It is further submitted that the similarly situated co-accused has already been granted bail vide order dated 26.04.2018 passed in Cr.Misc. no. 24921 of 2018. It is further submitted that the petitioner is languishing in custody since 13.10.2017.

Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Panjiwara PS case no. 71 of 2017.
