JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-01-2020 Heard learned counsel for the petitioner, learned counsel for the informant and the learned A.P.P. for the State. The petitioner is accused in connection with Kasba P.S. Case No. 206 of 2019, registered under Sections 323, 341, 324, 307, 504 and 506/34 of the Indian Penal Code. The accusation is that on 15.10.2019, petitioner, Kamar Alam, was engaged in cutting the soil through JCB machine over the land allocated to his share and the the share of land of the informant is also adjacent to aforesaid land of the petitioner. When the informant made protest then petitioner, Molvi Zakir and Shamshad caught hold him and the petitioner caused assault to him. When his both brothers, Sadab Alam and Noushad Alam rushed to save him then they were also

Learned counsel for the petitioner submits that due to land dispute petitioner and two others have falsely been implicated in the present case. Further submission is that petitioner is in custody since 17.10.2019.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnia, in connection with Kasba P.S. Case No. 206 of 2019. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
