Mr. Tarkeshwar Nath Thakur ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2020 It appears that earlier petitioner was granted bail, vide order dated 06.10.2018 passed in Criminal Misc. No.59256 of 2018 with condition that:

"Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond. That apart, in view of the antecedent of the petitioner, he would be required to appear before the Superintendent of Police, Vaishali at Hajipur within fifteen days of his release with a copy of this order and every two weeks thereafter for the next six months. The conduct of the petitioner will be kept under watch in the aforesaid period by the Superintendent of Police concerned and if it is found wanting in any respect, a report shall be made to the court concerned by him to initiate a proceeding for cancellation of bail for reasons of misuse of bail.

However, it appears that later on, on receipt of the letter from the Superintendent of Police, his bail was cancelled, vide order dated 07.08.2019 passed in Criminal Misc. No. 59256 of 2018.

Submission of learned counsel for the petitioner is that he is in custody since 29.08.2019 and he is ready to cooperate in the matter. Heard learned APP also.

Having heard both sides and in view of the submissions, made above, let the petitioner, above named, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-cum-Excise Court, Vaishali at Hajipur, in connection with Town Hajipur P.S. Case No. 26 of 2018, with condition that he has to appear before the office of the Superintendent of Police, Hajipur for a period of six months, so that police may watch his conduct, otherwise, his bail bonds shall be cancelled. With the above observations, this application is
