The petitioner in the present case is seeking regular bail in connection with Sour Bazar (Patarghat O.P.) P.S. Case No. 230/2019 registered under Sections 302/201/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that altogether seven persons are named in the First Information Report and there are general and omnibus allegation that all of them had killed the father of the informant. Learned counsel further submits that a learned coordinate Bench of this court has granted regular bail to the co-accused Rinku Rai who is husband of this petitioner and petitioner being in custody since 25.06.2019.

Patna High Court CR. MISC. No.76990 of 2019(2) dt.16-01-2020 2/3 Learned A.P.P. for the State has opposed the prayer for bail.

Considering the facts and circumstances of the case wherein it is the submission of learned counsel for the petitioner that altogether seven persons are named in the First Information Report and there are general and omnibus allegation that all of them had killed the father of the informant and further submission that a learned coordinate Bench of this court has granted regular bail to the co-accused Rinku Rai who is husband of this petitioner as in course of argument learned A.P.P. for the State is unable to demonstrate that the case of this petitioner would not stand on similar footing with that of the co-accused Rinku Rai, petitioner being in custody since 25.06.2019, let the above-named petitioner be released on bail furnishing bail bond of Rs.

15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Saharsa, in connection with Sour Bazar (Patarghat O.P.) P.S. Case No. 230/2019, subject to the condition as laid down under Section 437(3) Cr.P.C.

No.76990 of 2019(2) dt.16-01-2020 3/3 similar to the offence of which he is accused, or suspected, of the commission of which he is suspected, and (c) that such person shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any Police Officer or tamper with the evidence.
