JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 14-06-2018 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

The petitioner is seeking regular bail in Paroo P.S. Case No. 196 of 2018 registered under Sections 399, 400, 402, 414/34 of the Indian Penal Code and Sections 25(1-b)a/26/35 of the Arms Act.

It is submitted on behalf of the petitioner that even though there is an allegation of recovery of one country made pistol from the possession of the petitioner, some other weapons like iron Khanti, one steel rod and a knife is stated to have been recovered from the vehicle which do not belong to this petitioner. Learned Counsel submits that the petitioner is in custody since

No.33980 of 2018 (2) dt.14-06-2018 2/3 24.08.2017 in connection with the present case and during this period vide Annexure-2 series some of the co-accused similarly situated have been granted regular bail by learned coordinate benches of this Court. Learned counsel submits that even though there is only one case on the head of the petitioner, he is on bail in the said case.

Learned A.P.P for the State is present.

Considering the facts and circumstances of the case wherein it seems that the petitioner is in custody since 24.08.2017 in connection with the present case and some of the co-accused have been granted the privilege of regular bail by learned coordinate benches of this court, let the petitioner, above named, be released on bail on his furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 13th Additional Sessions Judge, Muzaffarpur, in connection with Sessions Trial. No. 125 of 2018, arising out of Paroo P.S. Case No. 196 of 2017, subject to the conditions as laid down under Section 437(3) Cr.P.C. and that the petitioner shall cooperate in course of trial by putting his appearance as and when dates are fixed by the learned trial court. In case the petitioner is found absenting on two consecutive dates in course of trial, the learned trial court shall cancel the bail bonds
