Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402, 413, 414, 467, 468, 471, 420 of the Indian Penal Code and Section 27 of the Arms Act.

Three persons including the petitioner were arrested by the Police on the premise that they and others were attempting to commit Dacoity. A motorcycle was recovered from possession of the petitioner, which was said to be a stolen property. The petitioner is in custody since 02.02.2018. The petitioner has got criminal antecedents.

Learned counsel for the petitioner submits that

No.35736 of 2018 (2) dt.27-06-2018 2/2 though the petitioner has been shown as an accused in several cases but in none of the cases the petitioner is named in the F.I.R., rather his name surfaced in the confessional statement of the coaccused. Considering the entire facts, let the petitioner, above named, be released on bail after nine months of custody, if the trial is not concluded before that, on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bhairav Asthan Police Station Case No.06 of 2018, subject to the condition that both the bailors shall be resident of within the territorial jurisdiction of the court below and the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
