Petitioner seeks bail in a case registered for the offences punishable under Sections 399/402 of the Indian Penal Code and Section 25(1-b)a/26/34 of the Arms Act. Petitioner and co-accused-Rajesh Kumar Singh and some others were apprehended on suspicion that they were preparing to commit dacoity. From possession of the petitioner, a country made pistol and cartridges were recovered. Petitioner is in custody since 19.10.2018. Investigation of the case is already complete. Co-accused Rajesh Kumar Singh has already been allowed bail by a Coordinate Bench of this Court vide Annexure-2.

Considering the aforesaid facts, let the

No.79039 of 2019(2) dt.04-12-2019 2/2 petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Chandan Police Station Case No.171 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
