The petitioners seek bail in Marhowrah P.S. case No. 114/ 2019 registered under Section 8/20 (ii) (c)/29 of the NDPS Act.

The police intercepted a truck container bearing registration No. RJ-18-GB-5025 and recovered 201.300 Kg of Ganja from the container.

The learned counsel for the petitioners submits that Arman Ali, who was also apprehended, has already been granted bail and the case of petitioners stands on same footing but it appears from perusal of the FIR and case diary that both the petitioners were driver of the container and it was the

Patna High Court CR. MISC. No.78095 of 2019(3) dt.19-03-2020 2/2 petitioners who were carrying huge quantity of Ganja in the container and commercial quantity of Ganja was recovered from the possession of the petitioners.

Considering the facts aforesaid and the nature of allegation made against the petitioner, I am not inclined to enlarge the petitioners on bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) BKS/- U T
