Petitioner is apprehending his arrest in connection with Gandhi Maidan P.S.Case no.70 of 2014 dated 24.2.2014 , registered for offences punishable under Sections 341, 323, 307 and 34 of the Indian Penal Code.

As per FIR, informant is the nephew of the co-accused Dinesh Kumar Singh and the petitioner happens to be brotherin-law of Dinesh Kumar Singh. There is allegation against the coaccused Dinesh Kumar Singh that he assaulted by knife and against this petitioner allegation is of firing but not hitting anybody and thereafter he assaulted by the BUT portion of the Pistol.

Submission of the learned counsel for the petitioner is

Patna High Court CR. MISC. No.80281 of 2019(2) dt.09-12-2019 2/2 that there is enmity between Dinesh Kumar Singh and the informant and the Title Suit is going on between them and he has been made scapegoat in this case. He is a student of the Chartered Accountancy. There is case and counter case between the parties.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge XVII cum A.C.J.M., Patna in connection with Gandhi Maidan P.S.Case No.70 of 2014 dated 24.2.2014 subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
