For issuance of a writ of Mandamus or any other appropriate writ or writs, order/orders, direction/directions, commanding the Respondents to remove the encroachment from the land bearing Khata No. 791, Khesra No. 2155, which

Patna High Court CWJC No.18491 of 2024(2) dt.05-12-2024 2/3 is Government Sairat land of the Fisheries Department, Sitamarhi and also from the land appertaining to Khata No. 678, Khesara No. 1162, 1164, 1872, 1873, 2124, 1114 and others, which is a Public land and belongs to Mandir (Temple) of the Villagers, upon which the present Mukhya-Respondent No. 9 has illegally erected PCC Road, without obtaining approval from the Aam Sabha of Mahadevpatti Panchayat, Parihar, District- Sitamarhi.

II. For further directing the respondents No. 1 to 8 to remove the entire encroachment from Khata No. 791 Khesra No. 2155, which is Government Sairat land of the Fisheries Department, Sitamarhi and also from Khata No. 678, Khesara No. 1162, 1164, 1872, 1873, 2124, 1114 and others situated at Mahadevpatti Panchayat, Parihar, District- Sitamarhi."

After some arguments, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Parihar, District-Sitmarhi, for redressal of his aforesaid grievances. Liberty, so sought, is granted.
