The petitioner seeks bail in Kalyanpur P. S. Case No. 156 of 2019 instituted for the offence under Section(s) 399,402 and 412 Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.

Since 30.06.2019, the petitioner is in custody in connection with instant case. It is submitted that the petitioner is innocent and has falsely been implicated in the instant case. In fact, there is no recovery as alleged in the F.I.R. The petitioner is accused in four more cases, as per disclosure made in paragraph no.3 of bail petition.. It is specifically stated that other than Dumariyaghat P.S. Case No. 71 of 2019, the petitioner is on bail in other three cases.

No.74892 of 2019(2) dt.11-12-2019 2/2 Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate East Champaran at Motihari, in connection with Kalyanpur P. S. Case No. 156 of 2019, subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
