Petitioner is apprehending his arrest in connection with Garkha P.S. Case No.295 of 2024, registered for the offence punishable u/s 302/34 of IPC.

Allegedly, the accused person committed murder of the husband of the informant and thrown the dead body of her husband in bush.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence. He has been falsely implicated in this case on the basis of suspicion. The petitioner is not named in the FIR and his name transpired on the basis of confessional statement of co-accused Durga Rai. It is further submitted that there is no specific overt
Patna High Court CR. MISC. No.84710 of 2024(2) dt.12-12-2024 2/2 act attributed against the petitioner. The specific allegation is against the co-accused persons who are named in the FIR. Petitioner has no criminal antecedent as mentioned in para 3 of the bail application.

Learned APP for the State opposed the prayer for bail. 6.
Considering the aforesaid facts and circumstances, nature of allegation and order passed by the Apex Court in the case of Indresh Kumar v/s The State of UP & Anr. (Criminal Appeal no. 938 of 2022), I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected.

This application is accordingly dismissed.
