JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-01-2020 The petitioner seeks regular bail in connection with Chakia P.S. Case No. 124 of 2019, registered for offences punishable under Sections 399, 402, 412 of the Indian Penal Code and Sections 25(1-b), a, 26, 35 of the Arms Act. Police on information of preparation of dacoity by some miscreants, raided the place and arrested the petitioner and recovered one country made pistol and two cartridges from the petitioner. Apart from that petitioner is accused in one more case of similar nature.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and other accuse persons have been enlarged on bail and he has been in judicial custody since 01.05.2019 and he is ready to abide by any condition imposed on him for grant of bail.

Having heard both sides, considering the facts and circumstances of the case as well as period of custody, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 13th Additional Chief Judicial Magistrate, East Champaran, Motihari, in connection with Chakia P.S. Case No. 124 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
