Mr. Bisheshwar Ram ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 07-08-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Mehsi P.S.Case No. 155 of 2015 registered under Sections 385, 386 and 387 of the Indian penal Code. Allegation in brief is that extortion money was demanded from the informant, who runs a cement shop, from the specific mobile numbers mentioned in the FIR and the caller name was also disclosed.

Submission is that four specific numbers of mobiles are mentioned in the FIR including the name of one person, Manoj Singh, who is said to have made demand of extortion. Petitioner is not named in the FIR and only material transpired during investigation against him is of disclosure of his name by Manoj Singh, FIR named accused, and it is also submitted that another

Patna High Court Cr.Misc. No.40598 of 2018(4) dt.07-08-2018 2/2 co-accused Sujit Kumar Singh, whose name was also disclosed by Manoj Singh, was granted bail by a co-ordinate Bench of this Court, vide Cr. Misc. No. 54786 of 2016.

Having considered the aforesaid facts and circumstances, as the case of the petitioner is on similar footing to Sujit Kumar Singh, so the petitioner, namely, Sudhir Singh @ Sudhirkumar Singh is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-VI, Motihari, East Champaran in connection with Mehsi P.S. Case No. 155 of 2015 with condition that one of the bailor must be his close family member. Petitioner shall remain physically present on each and every date during trial and in case of failure on two consecutive dates without any reasonable cause, his bail bond shall be liable to be cancelled.
