The petitioner seeks bail in connection with Islampur P.S. Case No.55 of 2019 registered under Sections 302/34 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that after recovery of the dead body and showing the photograph of the same, the dead body was identified by the informant as of his son Rajiv Kumar and, accordingly, the present case was lodged by the informant against unknown. In course of investigation, one Sanjay Chaudhary, who is own brother of this petitioner, was apprehended by the police, who confessed his guilt and
Patna High Court CR. MISC. No.80201 of 2019(2) dt.06-12-2019 2/2 disclosed the name of the petitioner having hand in the murder of Rajiv Kumar, the son of the informant. In fact, due to land dispute, Sanjay Chaudhary disclosed the name of the petitioner. The petitioner has no criminal antecedent and is in custody since 28.06.2019. Moreover, after investigation, the police has already submitted the charge-sheet against the petitioner. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Hilsa, Nalanda, in connection with Islampur P.S. Case No.55 of 2019.
