JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-06-2020 Heard Mr. Madhav Jha, learned counsel for the petitioner, Mr. Suraj Kumar for the informant and Ms. Anita Kumari Singh, learned APP for the State. The petitioner seeks bail in connection with Bangaon P.S. Case No. 18 of 2018 dated 03.03.2018 instituted for the offences under Sections 341, 324, 325, 307, 379, 384, 504, 506 and 34 of the Indian Penal Code.

The petitioner is alleged to have assaulted the informant by means of an iron-rod on his head and leg. Other accused persons are also said to have assaulted the informant and took away money from his person. It has been urged on behalf of the petitioner that an absolutely false case has been instituted for a reason. The mother of the petitioner was manhandled by

No.82258 of 2019(3) dt.05-06-2020 2/2 the informant of the present case for which the mother of the petitioner has lodged a case about which a reference has been made in this bail petition. The petitioner is in custody since 25.09.2019. The counsel for the informant has, however, submitted that because of the assault perpetrated upon the informant, his hand was fractured and he has also received injuries on his head. One of the injuries suffered by the informant is reported to be grievous. However, looking at the nature of accusation, the counter version of the occurrence and the argument raised on behalf of the petitioner that there was actually a dispute with respect to immersion of idol of Goddess Saraswati which led to altercation between the parties, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st , Saharsa in connection with Bangaon P.S. Case No. 18 of 2018.
