2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 204, 319(2) & 318(4) of the BNS, 2023.

3. The case of the prosecution is that the recruitment of constable was going on in regional office of CAPF, Kishanganj. On 0.10.2024, at about 6:30 P.M. the petitioner was wandering in BSF uniform near BSF premises. He was giving assurance to the candidates for their recruitment. It is further alleged that he had taken some documents of one Badal Kumar for his recruitment. The petitioner was apprehended in headquarter office at Kishanganj.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.85086 of 2024(3) dt.20-03-2025 2/2 petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that in this case there is no complaint as to from whom this petitioner has taken case for the recruitment. Further submission is that the petitioner was apprehended and he confessed his guilt and accepted that he has taken Rs. 1,00,00/- from a candidate but nothing has been recovered from his conscious possession. Moreover, the petitioner is languishing in judicial custody since 07.10.2024 having no criminal antecedent.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kishanganj P.S. Case No. 402 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj.
