2. The petitioner apprehends his arrest in connection with Sonbarsa Raj P.S. Case No. 81 of 2024 registered for the offence under Sections 406, 420 read with Section 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and other co-accused Mukesh Kumar Singh are said to have defalcated Rs. 50 lakhs.

4. Learned senior counsel for the petitioner submits that the petitioner is ready to pay Rs. 25 lakhs.

5. Learned counsel for the BSFC has no objection to this offer of the learned senior counsel for the petitioner.

6. In view of the above, the petitioner is directed to be englarged on provisional anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of

Patna High Court CR. MISC. No.89965 of 2025(3) dt.13-05-2026 2/2 the like amount each to the satisfaction of the learned concerned Court below in connection with Sonbersha Raj P.S. Case No. 81 of 2024.

As a condition of this order, the petitioner, at the time of furnishing his bail bonds is directed to produce a demand draft of Rs. 5,00,000/- and then only his bail bonds shall only be accepted by the Court below. Thereafter in the next one year, the petitioner will produce the demand draft of the remaining amount admitted by him, meaning thereby that he will produce a demand draft of Rs. 5,00,000/- in the Court below on the interval of every three months.

8. It is made clear that if the petitioner fails to bring the demand draft on time, his bail bonds shall be cancelled automatically. It is also made clear that if the petitioner pays the installments on time then the provisional anticipatory bail granted to the petitioner shall be confirmed by the Court below itself.
