In this case, the petitioner is apprehending his arrest in connection with Belhar P.S. Case No. 206 of 2016 registered for offences under sections 7 of the E.C. Act. As per allegation, a pickup van, bearing registration no. JH-17C 9591, was intercepted which was loaded with 62 bags equivalent to 31 quintal of P.D.S. Arwa rice. Learned counsel for the petitioner submits that the petitioner is neither the P.D.S. dealer nor does the business of rice rather he is a owner of the vehicle, in question, and he had no knowledge that his vehicle was being used for carrying rice for the purpose of black marketing.
Looking to the entire facts and circumstances of the
Patna High Court Cr.Misc. No.37246 of 2018(2) dt.04-07-2018 2/2 case, let the petitioner, namely, Sunoj Bhagat @ Sanoj Bhagat, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Banka in connection with Balhar P.S. Case No. 206 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioner for investigation/interrogation, he will remain present and if he would not present himself, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
