The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 79, 111, 141, 143, 145, 98, 296 and 3 (5) of the BNS, Section 13 and 14 of the POCSO Act, Section 79 of the JJ Act, Sections 3,4,5,6 of the Illegal Human Trafficking Act as well as Section 16 of the Bonded Labour System Act.

3. The case of the prosecution is that the petitioner is an associate of an Orchestra Operator and it is alleged that, on the information that the petitioner along with his associate was involved in engaging minor girls for dancing in Orchestra.

4. Learned counsel for the petitioner submits that the

It is further submitted that during the course of investigation, the recovered victim girls have given their statements wherein they have stated that they were working in the Orchestra and no specific allegation has been levelled against this petitioner regarding running the orchestra rather he is only an associate. It is further submitted that similarly situated co-accused, namely, Vinay Kumar has been granted the privilege of bail vide order dated 19.11.2025 passed in Cr. Misc. No. 76335 of 2025. Moreover, the petitioner is languishing in judicial custody since 15.08.2025.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Mahila P.S. Case (Saran) No. 75 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Additional Sessions Judge ( POCSO), Saran at Chapra, subject to the condition that the petitioner shall filed an affidavit to the effect that henceforth, he will not engage
