2. The petitioners apprehend arrest in connection with Belaganj P.S. Case No. 755 of 2023, punishable for the offences registered under Sections 147, 149, 341, 379, 504, 506 and 354(a) of the Indian Penal Code.

3. The prosecution case, in short, is that, the petitioners along with other co-accused persons armed with various weapons abused and assaulted the informant. Coaccused Surendra Yadav assaulted the informant on his head, when the informant's wife came to rescue him with informant's

Patna High Court CR. MISC. No.88092 of 2024(2) dt.20-12-2024 2/3 brother, she was also assaulted and misbehaved by the accused persons.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. Learned counsel for the petitioners also submits that no specific allegation of assault has been attributed against these petitioners. Specific allegation of assault has been levelled against co-accused, namely, Surendra Yadav. It is next submitted that there is case and counter case between the parties. The petitioners have got no criminal antecedent. Learned counsel for the petitioners further submits that similarly situated co-accused has been granted bail by this Court vide order dated 02.05.2024 passed in Cr. Misc. No. 34070 of 2024.

5. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioners.

6. Considering the aforesaid facts and circumstances, let the petitioners, above named in the event of arrest/surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Belaganj P.S. Case
