The petitioner seeks bail in connection with Kotwali P.S. Case No. 404 of 2019, registered under Sections 25(1-b)a, 26(i)(ii) and 35 of the Arms Act.

The accusation is that the Logger Cell Machine intercepted that two persons are planning for committing murder on mobile no. 6206863494, thereafter, informant proceeded to village Shankerpur at the house of Rahul Kumar, holder of the aforesaid mobile. On query, about aforesaid mobile number, he disclosed that Sintu Yadav talked him about problem from his wife's brother and brother-in-law, thereafter, he talked to Rahul Kumar of Srimatput, thereafter, informant went to Srimatpur,

Patna High Court CR. MISC. No.75233 of 2019(3) dt.22-01-2020 2/2 where Rahul Kumar, son of Dashrath Prasad Yadav, started to flee, but, he was apprehended from whose possession one country made pistol and three live cartridge recovered. Submission is that the petitioner has no criminal antecedent and is in custody since 26.09.2019. Further, submission is that the petitioner is Rahul Kumar, son of Arun Prasad Yadav and on investigation the charge sheet has already been submitted.

Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Kotwali P.S. Case No. 404 of 2019 to the satisfaction of the Chief Judicial Magistrate, Munger.
