2. The petitioner seeks bail in connection with Beldour P.S. case No. 265 of 2023 instituted for the offences under Sections 341, 323, 504, 506, 384, 386, 347, 379/34 of the Indian Penal Code.

3. Prosecution case, in short, is that all the accused persons including this petitioner formed unlawful assembly and intercepted the informant, assaulted him and looted silver bracelet (worth Rs. 12,000).

4. It has been submitted on behalf of the petitioner that the petitioner is in custody since14.09.2024 and has no criminal antecedent. The petitioner has falsely been implicated in the

Patna High Court CR. MISC. No.85238 of 2024(2) dt.10-12-2024 2/2 present case. No specific overt act is alleged against the petitioner. No incriminating material has been recovered from the possession or from the house of the petitioner rather the looted article was recovered from the possession of the coaccused, namely, Raja Kumar.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Beldour P.S. case No. 265 of 2023.
