JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-06-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Gopalpur (Rangra O.P.) P.S. Case No.270 of 2019, registered for the offence punishable under Sections 451 and 354(B) of the Indian Penal Code and Sections 8 and 12 of the POCSO Act. It is alleged in the First Information Report that in the night of the alleged date of occurrence, when the victim, a minor, was sleeping with her mother in her house, the petitioner entered into her house and attempted to outrage her modesty. When the victim cried for help, the informant and others rushed and attempted to catch hold of petitioner. In that exercise, petitioner's silver chain came into the informant's clutches, he, however, managed to flee away.

He submits that her statement does not fully support the case of the prosecution. The petitioner is in custody since 21.08.2019. He contends that the petitioner has been maliciously implicated because of certain dispute. Be that as it may, considering the nature of accusation and the fact that the petitioner is in the custody since 21.08.2019, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional District and Sessions Judge-cum-Special Judge POCSO, Bhagalpur, in Gopalpur (Rangra O.P.) P.S. Case No. 270 of 2019.
