2. The petitioner is apprehending his arrest in connection with Baikunthpur P.S Case No. 306/2022 dated 03.10.2022 registered for the offences punishable u/ss 406, 420, 467, 468 and 471 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and the co-accused person are alleged to have taken Rs. 5 Lacs and Rs. 1.5 lacs from the younger brother and sister of the informant on the pretext of providing job and got the joining letter of Post Office issued. On being inquired, the said joining letter was found forged. The said amount was not returned.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.85480 of 2023(2) dt.31-01-2024 2/2 that the petitioner has falsely been implicated in this case. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. Learned counsel has submitted that there is no any specific date and time given by the informant to give money to the petitioner. The illegal contact was made between the petitioner and the victims. No offence u/s 420 of the IPC is made out against the petitioner, who is a lady.

5. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the fact that the petitioner is a lady, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Gopalganj in connection with Baikunthpur P.S Case No. 306/2022, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.

7. The application stands allowed.
