JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 01-08-2018 The present petition has been filed for modification of paragraph 3 of the judgment dated 14.05.2018 passed in CWJC No. 8171 of 2018.
2. Learned counsel for the petitioner submits that paragraph 3 of the said judgment contains certain inadvertent errors with regard to the description of the work as well as non-payment pursuant to the final bill. It is stated that the work in question relates only to the construction of road "L030-T01 to Manjhanpur (VR10) package no. BR-04R-185" and payment of Rs. 18,98,513/- relates to
Patna High Court MJC No.1895 of 2018 dt.01-08-2018 2/2 outstanding amount of the work done by the petitioner and not the final bill as such.
3. The submission of the petitioner is borne out from the writ petition and accordingly, paragraph 3 of the judgment dated 14.05.2018 passed in CWJC No. 8171 of 2018 stands corrected to read as follows - "3. Learned counsel for the petitioner submits that pursuant to a contract entered into between the respondents, the petitioner completed the work in respect of construction of road, namely, L030-T01 to Manjhanpur (VR10) package no. BR-04R-185 against which an amount of Rs. 18,98,513/- has not been paid for work done by the petitioner."
4. The judgment dated 14.05.2018 passed in CWJC No. 8171 of 2018 stands modified to the above extent.
