Mr. Ram Priya Sharan Singh, APP ====================================================== CORAM: HONOURABLE JUSTICE SMT. SONI SHRIVASTAVA ORAL ORDER 14-07-2025 Heard learned counsel for the petitioner, learned APP for the State. No one appears on behalf of the OP.No.2 despite issuance of notice.

2. Petitioner apprehends his arrest in a case registered for the offences punishable under Section 498(A) of the Indian Penal Code and section 3⁄4 of the Dowry Prohibition Act.

3. The complaint case has been filed by the OP.No.2 making an allegation of demand of dowry and torture.

4. Learned counsel for the petitioner submits that the allegations made in the complaint are not correct and as a matter of fact, there is a complete denial of the marriage of petitioner with OP.No.2. The learned counsel has invited the attention of

No.87410 of 2024(5) dt.14-07-2025 2/2 this court to Annezure P-3, which are the documents pertaining to voter helpline, Adhar- card and some other certificates which clearly show that the name of the husband of OP.No.2 is one Chamru Das, not the present petitioner. It is further submitted that OP.No. 2 is already residing with her husband Chamru Das in village- Rampur in the district of Samastipur as has been stated clearly in paragraph -11 of the petition.

5. The learned APP for the State opposes the prayer for bail.

6. Considering the facts and circumstances and also specific denial of marriage itself, I am inclined to grant privilege of anticipatory bail to the petitioner. Let the petitioner, in the event of his arrest/ surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand)with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/ successor court in Complaint Case No. 558 of 2020, subject to condition as laid down under section 438(2) of the Cr.PC.
