The petitioner seeks bail in Bangaon P.S. Case No.78 of 2019, registered under Sections 379, 356 and 34 of the Indian Penal Code.

The informant alleged that he parked his motorcycle and while he was urinating by the side of the road, four persons came and took away his motorcycle, cash of Rs.28,500/- and mobile kept in the dickey of the motorcycle.

Learned counsel for the petitioner submits that the petitioner is not named in the FIR. The petitioner was apprehended and the police forcibly took his confession. Save and except confession, there is no material to show the involvement of the petitioner. Petitioner is in jail since 01.07.2019 but the petitioner has not been put on TIP, nor any

Patna High Court CR. MISC. No.79367 of 2019(2) dt.04-12-2019 2/2 incriminating article or the stolen article was recovered from possession of the petitioner. The petitioner is in jail for last five months.

Considering the facts aforesaid, petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-Ist, Saharsa in connection with Bangaon P.S.
