1. Heard the parties.
2. Petitioner seeks regular bail in connection with Naubatpur P.S. Case No. 596 of 2018 dated 08.12.2018 registered under Section 147, 148, 149, 341, 302, 120(B) of the I.P.C. and Section 27 of the Arms Act.
3. As per the first information report the allegation against the petitioner is that the petitioner alongwith F.I.R. named accused persons and other 4-5 unknown persons variously armed with pistol, gun and cartridges took informant's father towards South Badhar and after some time when the informant went in search his father, he found his dead body of his father in the field of Kant Paswan having fire arm injury on his right ear,

4. Learned counsel for the petitioner submits that petitioner is having no criminal antecedent and he has falsely been implicated in this case due to village politics. He further submits that no body has seen the occurrence and there is no eye witness and the name of the petitioner has transpired merely on the basis of land dispute. Similarly situated co-accused persons have been granted bail by different Co-ordinate Benches of this Court as stated in paragraph-9 of the bail application. The petitioner is in custody since 29.07.2024. Charge sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidence if released on bail.
5. Regard being had to the submissions made by the parties, taking into consideration the fact that similarly situated accused persons have been granted bail by Co-ordinate Benches of this Court, as such, I am inclined to grant regular bail to the petitioner.
6. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10000 /- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-1, Danapur in connection with Naubatpur P.S. Case No. 596 of 2018 subject
Patna High Court CR. MISC. No.188 of 2025(2) dt.23-01-2025 3/3 to the condition that the petitioner shall remain present on each and every date during the course of trial and in case of default on two consecutive dates, his bail bond shall liable to be cancelled.
