The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 341, 323, 324, 307, 379, 354 (B), 504, 506/34 of the Indian Penal Code. Allegation against the petitioners are that they have assaulted to the informant and others.
Learned counsel for the petitioners submits that there is case and counter case. The police has submitted charge-sheet u/s 307, 354 (B) and 379 of the I.P.C, but learned court below
Patna High Court CR. MISC. No. 78000 of 2019(2) dt.04-12-2019 2/2 has taken cognizance u/s 302, 354 (B), 379 of the I.P.C. against the petitioners. The petitioners have no criminal history and both sides have received injury.
In the aforesaid facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Benipatti, Madhubani, in connection with Benipatti, P.S. Case No. 130 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
