The petitioner seeks bail in Babubarhi P.S. Case No.188 of 2019, registered under Section 379 of the Indian Penal Code.

The informant disclosed that his motorcycle was stolen and during the course of enquiry, he came to know that the petitioner stole his motorcycle.

Learned counsel for the petitioner submits that the motorcycle of the informant was recovered from the courtyard of the petitioner but the petitioner disclosed that he purchased the motorcycle from Ranjit Kumar Sah on payment of Rs.12,000/-. The petitioner has got no criminal antecedent and he is in custody since 07.09.2019. The petitioner has remained in jail for more than six months for recovery of a motorcycle

Taking into consideration the facts and nature of allegations made against the petitioner and the fact that the petitioner has remained in jail for more than six months and he has got no criminal antecedent, petitioner, namely, Pradeep Kumar Thakur is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-III, Madhubani in connection with Babubarhi P.S. Case No.188 of 2019.
