The petitioner seeks bail in connection with Bishanpur P.S. Case No. 36 of 2019, registered under Sections 147, 148, 149, 323, 324, 307, 341, 504 and 506 of the Indian Penal Code.

The accusation is that 11 persons named in the F.I.R., including the petitioner, came near the informant Shatrughan Mahto and started to abuse, at that time, Amit and Dipak gave Farsa blow at his head causing blood oozing injury to him, when Kishori Mahto rushed there to save the informant then Shobhit Sahni (Petitioner) gave Sahat blow at his chest. When Raja, son of the informant, rushed then he was assaulted through rod by Navin and Sanjeev.

No.79327 of 2019(2) dt.18-12-2019 2/2 Learned counsel for the petitioner submits that while specific allegation is against the petitioner to cause Sahat (an instrument used for catching fish) blow at the chest of Kishori Mahto, but only two injuries i.e. 1cmX1cmX05cm over mid sternal area and swelling over check 2cm X 3 cm caused by hard and blunt substance were found. While injury No.1 is simple in nature, but the other is grievous in nature due to fracture left zygmotic arch. Further submission is that while petitioner is accused in two other cases, as detailed in paragraph No. 3 of the petition, but he is on bail in both cases. The petitioner is in custody since 26.08.2019. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-VII, Darbhanga in connection with Bishanpur P.S. Case No. 36 of 2019.
