Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 191(2), 190, 126(2), 115(2), 118(1), 109, 76, 352, 351(2), 351(3) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioners submits that petitioner no. 1 has antecedent of one case and petitioner no. 2 is a person with clean antecedent and the informant alleges that on 14-12-2024 at 5:30 AM, he was going to feed his cattle when eight named accused persons including the petitioners suddenly came and started assaulting him, and on order of Idris, accused

No.80623 of 2025(2) dt.11-12-2025 2/3 Herham assaulted by rod and he fell, thereafter Rozdin with dabiya and Nathuni with sword repeatedly assaulted causing injury on head and accused persons also assaulted his wife, who came to save him and disrobed her, further villagers came and injured were taken to hospital.

Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that the entire family members have been implicated on account of dispute relating to passage. It is further submitted that even presuming what has been alleged is true without admitting then the injury suffered by the injured has been opined to be simple in nature, as would manifest from the order impugned. It is also submitted that even blow is not alleged to have been repeated.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like
