2. The petitioner has preferred this application for grant of regular bail in connection with Digha P.S. Case No. 331 of 2025 dated 16.05.2025 registered for the offences punishable under Sections 126(2), 115(2), 308(4), 329(3), 352, 351(2) read with Section 3(5) of the B.N.S., 2023.
3. As per the prosecution case, the informant has given construction work of Market Complex, to S.S. Construction. On 13.05.2025, an unknown person came and asked for the informant's mobile number from the Supervisor, namely, Raushan Kumar, and told him to speak on the phone who identified himself as Bhim alias Shatrudhan (petitioner) who threatened to stop the construction and warned of serious

On 15.05.2025, five unknown men including the petitioner came to the informant's residence and threatened his father-in-law (a retired army officer) demanding Rs. 50,00,000/- as extortion money otherwise they would kill the entire family.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The name of the petitioner has sprung up in this case on mere suspicion. No TIP has been concealed by the prosecution. The petitioner has seven criminal antecedents in which he is on bail in all cases as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 21.05.2025. The co-accused person has already been granted regular bail by this Court vide order dated 13.10.2025 passed in Cr. Misc. No. 66971 of 2025.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and submitted that from perusal of Para Nos. 19 and 20 of the case diary, it transpires that the present petitioner was identified as Satrudhan Kumar @ Bhim, was also seen in CCTV footage who visited at the house of the informant and threatened the father-in-law of

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IX, Patna in connection with Digha P.S. Case No. 331 of 2025 with following conditions:- (i) The petitioner is directed to remain physically present before the learned court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
(ii) If the petitioner is found involved in similar nature of offence in future, the prosecution will be at liberty to move for cancellation of his bail bond.
