The matter has been listed under the heading 'For Orders' under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is apprehending his arrest in a case registered under Sections 376, 511, 354B, 506, 323 of the Indian Penal Code and section 4 of the POCSO Act.

The prosecution allegation, in short, is that the accused person came to the house of the informant and torn the cloth of her daughter and tried to outrage her modesty. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no

Patna High Court CR. MISC. No.79698 of 2019(5) dt.07-09-2020 2/2 allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. After investigation, the police submitted final form against the petitioner and found the case to be false. Other coaccused has been granted anticipatory bail vide Annexure-3 to the present application by a coordinate Bench of this Court. On behalf of the State, it is submitted that the petitioner is named in the F.I.R./complaint case. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of eight weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.

10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned 1st Additional District & Sessions Judge-cum- Special Judge, POCSO Act, Bhagalpur in connection with Habibpur P.S. Case No. 24/18, G.R. No. 716/18, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
