JUSTICE ASHUTOSH KUMAR ORAL ORDER 11-12-2019 The petitioner seeks bail in connection with Special Excise Case No. 8299 of 2019 arising out of Mokama P.S. Case No. 215 of 2019 which has been instituted for the offences under Sections 30(a) of the Bihar Prohibition & Excise (Amendment) Act, 2018. It has been alleged that forty litres of liquor was recovered from an abandoned place and the petitioner and two others are stated to have thrown the aforesaid consignment of liquor on seeing the police party. The F.I.R further discloses that the raid was conducted only on secret information/tip-off that the petitioner along with his associates are indulging in sale

Patna High Court CR. MISC. No.76824 of 2019(2) dt.11-12-2019 2/2 and purchase of liquor in an unauthorized manner. The petitioner is not stated to have been arrested at the spot. His name has been taken by a seizure list witness in whose presence recovery of forty litres of liquor is stated to have been made. The petitioner does not have any criminal antecedents and he is in custody since 14.10.2019. For the period of custody of the petitioner and his clean antecedents, he is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Excise Case No. 8299 of 2019, arising out of Mokama P.S. Case No. 215 of 2019.
