This is an application for grant of anticipatory bail in connection with Jokihat P.S. Case No. 326 of 2016 registered for the offence punishable under Sections 467, 468, 471, 409 and 420/34 of the Indian Penal Code.

The allegation is regarding the petitioner no. 1, who is the PACs Manager and the petitioner no. 2, who is the executive member of the PACs in question having not deposited the adequate C.M.R., after having lifted paddy for the purposes of processing the same.

The learned counsel for the petitioners submits that the

No.75108 of 2019(2) dt.25-11-2019 2/2 petitioners are continuously requesting the District Cooperative Officer, Block Cooperative Officer and other authorities to take back the paddy, however, no action is being taken, instead the present case has been lodged against them. The petitioners are stated to be having a clean antecedent.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with each two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi in connection with Sitamarhi P.S. Case No. 266 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Mohit Kumar Shah, J) ajay gupta/- U T
