2. The petitioner is apprehending his arrest in connection with Khanpur P.S. Case No. 205 of 2021 for the offence under sections 30(a), 41(1)(2) and 47 of the Bihar Prohibition and Excise Act lodged on 28.08.2021 by the informant, Dil Kumar Bharti.
3. As per the prosecution story, the informant alleged that on secret information, a pick-up van and a truck were searched and there is recover/seizure of 3485.16 liters of foreign liquor. This led to the FIR.
4. Learned counsel for the petitioner submits that he is neither the driver nor the owner of the truck/pick-up van but a daily wager and only because those implicated named him as also the fact that he has criminal antecedent, is facing the case.

5. Learned APP opposes the prayer submitting that not only the matter is of the year, 2021, huge recovery has been made coupled with the fact that the petitioner has criminal antecedent.
6. Considering the submission of the parties as also the delay in coming to the Court despite being named and the huge amount of recovery, it would be appropriate that he seeks bail.
7. The anticipatory bail application stands rejected.
8. If, however, the petitioner surrenders within four weeks, the concerned Court shall take up the matter and dispose it of preferably on the same day.
